Manželství a manželské spory ve světle raně novověké knihy svědomí

Bakalářská práce Manželství a manželské spory ve světle raně novověkých knih svědomí se v první kapitole zaměřuje na přístup církve katolické i jednoty bratrské k manželství. Tato část práce popisuje vzrůstající vliv církve během 16. století na soužití dvou lidí a uzavírání sňatků. K tomuto tématu jsou zde uvedeny nejdůležitější koncily, které ustanovily přesné zásady týkající se manželství. Další část této kapitoly se věnuje uzavírání svatebních smluv a věnu, které již do kompetence církve nespadaly. V této souvislosti jsou zde představeny důležité právní prameny, které řešily otázku věna. Druhá kapitole se podrobněji zabývá výběrem partnera pro život, zasnoubením a rituály, které sňatek doprovázely. Poslední část práce je zaměřena na spory a problémy mezi partnery, snaží se zachytit nejčastější příčiny konfliktů a určit jejich příčinu. V obou posledních kapitolách byl použit pramen ze 16. století kniha svědomí, sepsaná u konzistoře podobojí.

 

Marriage and matrimonial lawsuits in the light of the early modern books of conscience

The bachelor essay on Marriage and matrimonial lawsuits in the light of the early modern books of conscience in its first chapter is aimed at approaches to the marriage of both the Catholic Church and the Unitas Fratrum. This part of the essay describes increasing influence of the Church during the 16^th century on a common life of two people and their entering into marriage. On this topic the most important councils that appointed strict principles concerning marriages are presented here. Another part of this chapter is devoted to the conclusion of marriage settlements and the dowries which, however, were not within the competence of the Church. Important legal sources dealing with dowry questions are presented here. The second chapter in more detail deals with choise of a partner, engagement and rituals that were connected with the marriage. The final part of the essay is aimed at lawsuits and problems between partners, it tries to depict the most common reasons of the conflicts and to define their causes. In both of the final chapters a source from the 16^th century, a book of conscience, that was drawn up by the Calixtine Consistory, was used.
